That's not actually what constitutes being a spammer:
spammers send huge volumes of unsolicited commercial email
or huge volumes of commercial newsgroup postings.  The "huge
volumes" and "unsolicited commercial mail or newsgroup
postings" are necessary parts of the definition of spammer.

What you are seeing is just someone who (probably) made a
mistake, and it's a very easy one to make.  I've done it
myself upon occasion.
