Re: [GWL]: Copyright of edited versions?
I do seem to recall that this same issue was raised relating to the digital
changing of images and there was a ruling that a SUBSTANTIAL
change/modification must occur for a NEW image to have been created. I
believe that the ruling was that the modified image was owned by the
original creator, not the person who performed the modification. The issue
related to a photographic image that was digitized and modified for use in
an advertisement so there were big bucks associated with the settlement. In
this case the rights to use the original image had not occurred - it was
appropriated without compensation.
It would seem that the intent is that normal editing of a image or text for
publication does NOT constitute a new work that can be copy protected.
In my opinion, the editor/publisher is blowing smoke and counts on it being
too much effort for an author/owner to pursue the matter in court.
