Re: gardenwriters Digest, Vol 37, Issue 14

Of course not, but that has nothing to do with my point either.

<The photographer misrepresented themselves on the job... shot photos for
their own use outside of the assignment they were on (staff, not
freelance).>

This is not what you said he did in your original post, and I don't know how
you can be so sure of this. You have no knowledge of any misrepresentation,
only the end result. All you told us is that he was sent for the newspaper
assignment and then later you saw them used elsewhere. Nothing in your
original post tells us how you or anyone else can possibly know what whether
his intention at the time you met him was to use them elsewhere later. Your
initial impression of the man was that he was an honest, ethical fellow.
Nothing in your story has given me any reason to doubt your own impression,
made at the time, on the ground, in his presence. Perhaps he is a clever
fiend who did mean to deceive you, but it's more likely that the situation
came up after the fact. That's just the way the world usually works. Most
conspiracy theories are built up from circumstances but never reflect
reality.

<I make a living from my garden and the photographer knew that. Circles are
very small in this area and we all know or bump into each other relatively
frequently.>

This supports my point even more strongly. Given this fact he would be
stupid to deceive you and it would be so easy for him to have just asked
you. As you said, he was an ethical, easy person to get along with. Sure,
clever bad guys smile as they stab you in the back, but most people don't
work that way & survive, especially in small communities.

<Quoting the constitution, legalities, sub sections, by laws, etc. still
does not excuse bad behavior, legal or not. When you lie... misrepresent...
whatever word you choose to use.... shame on you from my book. >

I'm with you there, Gene, just gotta find some bad behavior to wag the
finger at. Just getting your garden's photos published or shown around
without your imprimatur doesn't qualify in my book. Of course you took the
bull by the horns, made lemonade out of this lemon, blew up multiple copies
of the article, pasted them conspicuously around your nursery, used them in
your ads, wrote a letter to the magazine, etc, etc, etc?
