For what it's worthâ
I asked the GWA lawyer for information in 2001 or 2002 about who owned the
photograph even if there is a sign saying that pictures cannot be taken. While
the Exec. Director of GWA told me off-the-cuff that it was extremely
important to get permission and releases and all, I persisted and got the lawyers
opinion. He said the photographer owns the photo and the copyright. No
permission or release is required. Now if you plan to generate a Chanticleer calendar
and use all photos of Chanticleer you would probably get into trouble. Of
course it is such a nice garden you would probably work with them anyway.
It's a bit like a recipe--which is a list. You cannot copyright a list (or a
recipe) only the particular presentation of it. If I have butter and eggs in
my recipe, together, I cannot sue someone else who has butter and eggs. Gardens
could be considered lists.
I am not a lawyer but I think since this is a legal issue, a lawyer should
step forward and solve the anxiety.
