KATE, I am a lawyer....( "America's Dirtiest Lawyer" is the moniker due to the garden writing as well).
Hiring a lawyer would be a waste of time. Write your own letter and then threaten to go to small claims court. If nothing happens, then walk away. It isn't worth going to small claims court for under 500 dollars IMHO.You should always "cc" some Attorney at Law at the end of these kinds of letters. If you want, you can make up a name or use mine.
In you letter review the facts in case the company does get money in a while and you do want to try again, the subsequent promise to pay you (which extends you statute of limitations in case you want to try again later) and your course of action: "considering small claims court AND an alert through several channels you have with writers not to work for the company until you do get paid. Polite, firm, emotionless and only to the point. No nagging, whining, no yelling, no crying.....just the facts and only the important ones.
Who knows, it might work.
People are awful sometimes. Most of the blame gets put on lawyers, but it is handy to have one......In this case, I am telling you that even a lawyer won't be much help, as you can tell!
