Hi Lorraine,

My agreement with a large national publisher stipulates that they are buying
all rights to publish a GARDEN, and I may not use photos they reject
elsewhere. It's not negotiable. They pay well and are an 800-pound gorilla.
That said, I do get requests from homeowners for copies of pictures. I
usually refer them to the editor, or the photographer who did the actual
shoot.

If EN bought the photos on any terms other than first or one-time rights,
you no longer own the copyright to them. But even if you do, you may want to
consider that you would not have had your story without the restaurant's
generosity.

One of my writing gigs has been for Edible Nutmeg and had the chance to do a
restaurant review for the last edition. The restaurant has now asked for
some of the photos for their use and I have no idea what to charge. I'd
appreciate any input from the editors and photographers on our list re how
to price out this request.
