[GWL]: legal status of copied articles vs links


If the NY Times invites us to send a copy to a friend, that is 
individual copies to individual friends (for free).  It benefits the 
Times, because it is excellent advertising, hence the permission.  

If I refer to a Times article in this list and give the link, members of 
GWL go to the Times and follow Times rules and see Times advertising.  
The article is published by the Times website, and GWL users are simply 
accessing their website using ordinary rules.  

If I cut and paste an article from the Times into a post on GWL, I have 
PUBLISHED the article.  Posting something on a website is publishing it. 
 Publishing a work by someone else without explicit permission is 
against copyright law.  The Times has reason to be displeased, because 
members of GWL will now be reading the article without playing by Times 
rules or seeing any of their advertising.

Certainly many websites are playing fast and lose with copyright law.  
Many involved are oblivious to copyright issues.  In addition, the 
internet is new, and we are all still learning.    

As writers, though, I think we will want to be maximally careful and 
correct about copyrights, under the basic Do Unto Others rule.  So I 
think we should cheerfully use relevant links, but refrain from copying 
articles without explicit permission.
