Another resource for information about plant patents is the web. Patents  
apparently are for 17 years, which would effectively take this hybridizer out of  
the mix in the case of the Oregon project. Companies have claimed rights to 
all  genetic engineering in particular kinds of plants as well as the  use of 
particular genes in any plant. In my opinion some of these patents are  
over-broad. It is like granting a patent for "cake" then granting a patent  for 
putting every individual ingredient, and  patenting every single step in the making 
and baking of a cake! 
 
The situation is complicated by a lack of case law, because it is so  
expensive to challenge these patents, no matter how absurd they seem.
