We grow potatoes from old shrivelled store bought potatoes, and there's
nothing wrong with them at all. Why waste them? There might be some patent
violation (technically), but I doubt it. I've heard rumors of growth
inhibitor treatments to make them so they won't grow, but that's silly,
they grow just fine, and I'm sure that if they did treat them that way
there would be some sort of public outcry about putting such things in our
food.
Personally I think the sellers just want you to buy their potatoes (whether
it be to eat or to grow), rather than growing your own, and perhaps promote
some of the rumors about them not growing if they were bought as food
instead of (higher priced) "seed".
Go for it, it works just fine.
