I percieve a lot of snipping here... First, lets try to be civil.
I'm trying to compose this with a civil frame of mind. (I'm not
shouting...)
PVP (Plant Variety Protection) does not mean that only one person
can sell a seed. It just means that that person holds the rights
to that seed. The holder of a PVP can "license" to whomever they
wish the right to sell that seed. The 50 or so seed companies out
there that sell Dill's Atlantic Giant seeds necessarily need a
license to do so, from Dill (or his company). (Correct me if
I'm wrong.)
If a non-licensed seller were to sell AG seed, I'm thinking that
this would be technically in violation of the PVP. But this would
be a civil matter rather than criminal. (Correct me if I'm wrong,
which is likely.) This would mean that the holder of the PVP would
need to take the violator to court (expensive), and sue for
damages (hard to prove, and certainly limited given the small-time
nature of the violator in the first place). Its likely that the
small time seller is untouchable. Please understand, I'm NOT saying
that its cool or even legal to do this, but just spelling out some
realities as I understand them.
Finally, I think its safe to say that there will always be
excellent and free AG seed available. This hobby (sport) will not
die. Too many good people out there will ensure that.
