Siberian patents ?

This brings up a question I've had in mind. I've been wondering why
Siberians aren't patented. I grow a lot of roses, the patents are supposed
to protect them from being rooted and sold or traded by name. It sounds like
the Iris Hybridizers spend an enormous amount of time ( up to 5 years)
developing new irises and getting them ready to market.
Is there a way to protect your investment? I see the new ones selling for
up to 50 dollars but how many can you sell at that price? What about the
2nd and third year. Seems like any one could then grow and sell or trade
them by name.
Could it be that the market for Siberians isn't large enough to warrant a
patent ?
Any way I've been wondering this for some time and I discuss it with Leroy
last week. Perhaps some of the other "Big Guys" could share their
thoughts.
