There was a thread on plant patents either on this list or the LA iris list 6 months to a year ago. I remember one person who seemed to have a real good knowledge of the topic stating that irises could not be patented. Simplistically plants that clone them selves like irises are not patentable. Something like roses which do not naturally clone themselves can be patented. It takes human intervention (i.e. cuttings) to clone a rose so that activity can be regulated. An iris is going to clone itself because it has to do so to survive. Believe it or not, even our government usually doesn't want to get involved in enforcement issues that are a losing cause. Enforcing patent privledges on something that clones itself is a losing proposition.
