Hi Debbie,

   Today I received official word from Spring Meadow Nursery regarding
   the naming of this plant.

   It seems that it is *not* patented, so the plant label is wrong and
   propagation is allowed.  Redistribution with the trademark name
   without paying license fees is, of course, a big no-no.

   They say that the label will be corrected in future print runs.
