Symphoricaropos Amethyst [TM]

I've been looking at the plant labels that I need to distribute with 
Symphoricarpos x doorenbosii 'Kordes' (Amethyst [TM]) and noticed that
there's no patent number or PPAF designation.

Yet the plant label says 'Propagation prohibited without a license'.  If
there's no patent designation, isn't propagation open to anyone?  The only
restriction is use of their name, Amethyst [TM].

Does anyone have any information about the patent status that I may have 
missed?
