This--finding 4-inch plants in a gallon can--is a surprisingly common problem, I think. And it seems to get worse as you go up in size; that smallish 7-gallon plant is really a large 3-gallon plant in disguise. And when you're in a high-turnover area [lots of new construction that needs to be landscraped before the county will issue certificates of occupancy] it can become almost fraudulent. The pressures on growers must be enormous, and the stakes are very high.
