The National Aquatic Invasive Species Act (NAISA) of 2003 includes, 
amongst other things, a requirement that a list be drawn up of all 
'live aquatic organisms' in trade in the U.S..

Within three years of enactment, any import of a 'live aquatic 
organism' which is not on this list, will require screening and 
approval.

The 'live aquatic organisms' will include all plants and fish 
currently in trade in the water garden, aquarium and horticulture 
sectors. The only trade group I know of in the USA who is involved 
with this is connected to the pet industry (PIJAC), though I have no 
idea if they have been involved in the hearing that you mention. (I 
support OATA, the group representing the aquatic industry to the UK  
government.)

It is likely that similar legislation will eventually extend to 
ornamental garden plants in the U.S. and other countries.

All gardenwriters will appreciate the importance of addressing the 
dangers of unwanted invasives. However I agree with your worries 
regarding the lack of representation from horticultural groups. 
Heavyhanded legislation could soon severely limit the range of plants 
on offer to gardeners and restrict what nurseries can grow. 
Government does not always appreciate the value (aesthetic and 
monetary) of the horticulture trade. With a proposed $170 million on 
the table for aquatic invasive species prevention, the aquatic 
horticulture trade is going to have to speak out very loudly to 
defend its corner.
