All the form contracts, author friendly clauses, and wonderful terms in the world aren't going to help if the publishers won't sign. Doing these things on a case by case basis (especially with an attorney--the only contracts for a writer I've ever written have been my own) won't be at all feasible on an economic basis. If the relationship is worth it and the parties are willing, my suggestion is to work out a standing agreement for future work so that terms continue to be the same, even if word and dollar counts are not. This assumes, of course, that the publishers value the work and/or the relationship enough to give a little. In most cases it isn't going to happen.
 
There was a running discussion on another list about the large cadre of writers who would do it just for a byline. (Commercial plant growers feel much the same way about backyard nurseries). If newspapers and magazines are content to have these folks do their writing, we're just out of the loop. Hey, it's just business.
 
I hate to be pessimistic--but feel that a realistic view of the situation serves us all better. At least we know what we're up against. There will always be a place for good garden writing (now where the heck is it--and how can I get a piece?).
