I believe that unless a seed variety is under federal protection, such as trademark, copyright or patent...it's name can be changed by anyone who chooses to market it.  This would be especially true of a species...for example Coreopsis lanceolata (sp) can be called Brilliant Sun by one retailer or Stunning Sun by another and yet a third name by another.  In fact, it's not protected, is a species and no matter what anyone calls it...it's the same.  If they make claims that it's new, different or improved...then let them prove it through the legally accepted process.
