Re: crediting the gardener (was photo releases )


How much is this like reprinting in a different publication a first rights 
piece of written work without securing permission from the author?

 Consider the garden as the piece of work, the photograph the editing.  The 
only difference I see here is that the photographer went to the site.
The writer creates their piece, the editor, usually, improves it.
The gardener creates their plot, the photographer presents it at its best.
Properly done, everybody benefits financially either immediately or through 
generated publicity that can translate into dollars later on.
 (I would suggest that we don't argue about the  knowledge, artistic 
creativity, etc.  required by either the editor or photographer- different 
skill sets but both do essentially the same thing.
