"Public" gardens and photography restrictions

I have a question about public gardens, particularly ones that are funded
with state or federal tax dollars.
How is it that gardens like this are allowed to limit what you do with
your photographs?
The garden that sticks out in my mind is the Allen Centennial Gardens at
the University of Wisconsin, Madison. Their Web site is at

The first time that I went there they didn't have any restrictions on
photographs, but when I went back there again a few years ago a sign
said that no photography was allowed if it was ever going to be used
for commercial purposes (I think they allowed it if you petitioned them
first or paid a fee, but I don't remember because I kind of stopped
paying attention by the time I got to that part).
I have a hard time accepting a policy like that when it's hosted by a
public University that receives funding through taxes.
Of course, I also take issue with federal and state-funded research
programs patenting and trademarking plants... :)
