I've done garden themed feature articles and reviews for our major daily's
Sunday garden page. Over the years I've developed a relationship with the
editor and there has not been a written contract (yes, I'm an attorney and
I've worked without a written contract--may have had a letter agreement on
the first one...). The terms, however, are always clearly understood "First
North American Serial Rights". I also supply photography--with a separate
charge.
Some time into the relationship, I did a personal name search on the net
(try it sometime to discover things about yourself you didn't even know). I
learned that my work was appearing on the paper's web site--without notice
and without additional payment. I immediately notified the editor and said
that without additional agreed upon payment they were overstepping their
bounds. Rather than pay, they agreed to pull the articles.
Ever since, the editor has cooled. There has been a definite trend to
syndicated work (most of the page is done by writers out of state--except
for the extension stuff), and the free-lance budget is real tight and
growing smaller. Early on I wrote a spate of articles for her on the "use it
or lose it" theory. If she didn't spend her freelance budget, she wouldn't
get it the next year. Now she doesn't get it to begin with and local
freelancers suffer.
Oh, well...magazine work pays better anyway. But I still won't do "all
rights" deals. No one has offered "all right" money.
