Re: Linda's situation
At least two contributors to this thread have made statements to the effect
that newspapers rarely require contracts. My experience has been otherwise.
I contribute regularly (on non-garden-related subjects) to two local papers
in Lancaster, PA, and both have recently (post-Tasini) drafted contracts with
terms that raised my eyebrows sufficiently to require negotiating -- with 50%
success.
I got the heinous "work for hire" phrase stricken from one contract, but it
keeps reappearing on every expense form they send me. I just cross that part
out and send it in, figuring that if there's a dispute the contract will
prevail.
In the case of the other paper, the all-rights-everywhere-forever wording
remained intact, and I didn't fight it very hard because I rarely send them
anything that has a market elsewhere.
But I regret having done so, because now that contract is a barrier to my
approaching them with stories that would fit well in at least one of their
three publications.
I have to wonder if publishers who insist on ALL rights, ALL the time, and
have succeeded in getting some writers to acquiesce sometimes, realize what
they've lost in the process -- i.e., that they've voluntarily relegated
themselves to second or third choice of venues.
