If this is how you interpreted my initial email, then it is I who didn't express myself well. Reading the decision makes it obvious that your statements above are true, and I didn't think that my initial email stated point 1 or 2 above.
I practiced law for 20 years. I was not suggesting that people read this case and jump to conclusions. As you are no doubt aware, every case stands on its own facts and no two are exactly alike. Every lawyer takes principles, findings and conclusions from other cases to argue his/her own. My intent was merely to stimulate discussion of the issue...not the fine points of legal procedure.
