[GWL]: deed restrictions


You can lead a horse to water but .... 
   This seems like a good topic for a piece in a magazine, which can devote
more space to the subject than can newspaper garden slots. It's my
observation that many people are caught blind by the tightness of  land
covenants/deed restrictions because they didn't pay attention before signing
the dotted line. We as writers can stress that
gardeners/homeowners/yardeners learn about such restrictions, but we can't
make them do so. Maybe we should jump up and down and wave red flags to get
people's attention, though. The horror stories are legion here, where a new
subdivision pops up almost daily. The latest ones concern flying the
American flag (yes, illegal in some subdivisions). A few years ago, when
Florida was dying from the worst drought in a century, a homeowner was
penalized for Xeriscaping her yard. She actually had to tear it out and
replace it with a lawn. The general reaction from victims is ... 'I didn't
know.'  Salespeople don't make it easy. I recently was house-hunting with my
parents, who want to move closer to us, and the salesman repeatedly
downplayed the restrictions in one particular, brand-new community (model
homes very beautifully laid out/landscaped, etc.). "Oh, you don't want to
see that," he said when my dad asked to see a full copy of the covenants.
"It's about an inch and a half thick and full of small print."  Well, that's
exactly why my parents wanted to see it! Needless to say, this community is
off my Mom and Dad's list. Restrictions go far beyond homeowners
associations these days.

  P.S. The salesman actually said, "Well, we wouldn't want you to plant corn
in the front yard" (!) when he was trying to shrug off serious discussion of
the rules.
