[GWL]: Ruth Stout's reprint rights


A couple of people have commented upon the fact that the current issue 
of OG includes a reprint of a classic article by Ruth Stout, who has 
been dead for a while -- and wondered about permission and reprint fees.

Current copyrights are valid for 50 - 100 years beyond the author's 
death, depending upon the date of the writing and some other details.  
(It's 100 years now, for a registered work.)  If the author is deceased, 
heirs own the rights and receive the fees.     

However, for the couple of decades I've been watching, Organic Gardening 
has been requiring all-rights contracts.  I never wrote for them for 
that reason.  And I know many other writers who also practiced avoidance 
because of the contract situation.

My guess is that Ruth Stout signed all-rights contracts.  If so, Rodale 
can reprint her work in perpetuity in magazines or books without 
permission from anyone or further compensation for her heirs.  That is 
what "all-rights" means.  That is, the writing is the property of 
Rodale.  They can use it however they wish.  Anyone else who wants to 
use it (including the original author) would have to buy the right from 
Rodale.  

I note from the listing at Amazon that Ruth Stout is due to publish a 
"new" book in 2002, in spite of having been dead for years.  My guess is 
that this will just be a collection of magazine articles that Rodale 
already owns.
