Thanks for your post. Further to your question--the language in my contract
pertains to plagiarism and defamation. Obviously I am not going to
plagiarize! And I know that defamation is very hard to prove under US law
(malice and all that).

But I have no practical experience in this area--in my previous working life
I dealt with the arcana of international trade policy. My husband, on the
other hand, practices intellectual property law and is extremely attuned to
frivolous lawsuits, as they have occured in the context of cases he has
worked on, costing him and his firm time and money even when the claims were
without merit. I wasn't particularly fazed by the language in the contract,
but it leapt out at my husband. When this happened in his line of work, the
firm bore the financial burden, but in my business I'm all there is.

I worked full-time at Landscape Architecture magazine for a couple of years,
and while the magazine has run some tough articles under the tenure of the
current editor, my understanding is that this issue hasn't come up. Which
leads me to believe it's unlikely to come up with respect to the book. It
will focus on designing, building, and maintaining green roofs, offering
lessons from projects built over the past decade. It's now pretty clear that
some approaches work better than others. I don't think making that
observation defames anybody (and it's not surprising that with a new
technology such as this, there is going to have to be a lot of trial and
error) and I haven't heard of any lawsuits being filed over issues like
this. But again, I'm pretty new to this and don't want to err on the side of
either paranoia or blissful ignorance.
