The Software Money-Back Guarantee petition is a campaign to compel software
makers to stand behind the products they sell -- by offering to refund your
money if you are not satisfied. When you sign the petition, you will have
the opportunity to determine the length of a fair guarantee (30 days or 60
days).

Although it seems deceptively simple, it is a powerful way to convince
software companies to put your satisfaction first. By pledging to support vendors who
offer the Software Money-Back Guarantee, users remove the incentive for
vendors to rush buggy, over-hyped products to market. We will formally submit the results of the petition to leading software publishers and trade associations.

<B>History of the Software Money-Back Guarantee</B>
<P>
The Software Money-Back Guarantee petition was created after a column by
<I>Windows Sources</I> editor David Berlind uncovered widespread consumer
frustration. Frustration with such non-guarantees as the one David found
with a copy of Lotus SmartSuite:<P>
<I>"Lotus warrants that the Software will substantially conform to the
applicable user documentation...Lotus makes no warranty or representation,
either express or implied, with respect to the Software or user
documentation, including their quality, performance, merchantability, or
fitness for a particular purpose."</I><P>
No warranty with regard to performance? Or quality? Or fitness for a
particular purpose? Considering that consumers are almost never permitted
to test-drive software before purchase, that hardly seems fair.
<P>
David's column, entitled <A
HREF="http://www.zdnet.com/chkpt/adxsmbg01/www.zdnet.com/wsources/content/0298/fob_setup.html">Why We
Need a Software Lemon Law</A>, triggered an avalanche of mail. From
customers fed up with being stuck with expensive software that didn't work
as advertised. From customers stuck with software that was buggy (last
month BugNet.com set a new world record by publishing more than 500
bug/fixes in a single month). From customers stuck with software that is
plain unsatisfactory.
<P>
Thus, we posted this "Make-A-Difference" petition to protest this unfair
treatment of software consumers. We believe it is high time software makers
stopped over-hyping their products. Stopped treating consumers like beta
testers. And started standing behind what they sell. (Note: After careful
consideration and research, ZDNet AnchorDesk opted to give software vendors
the opportunity to do the right thing voluntarily -- before asking the
government to step in and pass "Lemon Law"-style legislation.)
