Well I'm pretty sure that it doesn't matter if the temp is below 40 F or near or freezing.
The 40 F is chosen because that is the maximum temp at which vernalization can occur (in theory). And there really is no point in going colder tha 32 F, right?
I think it should make no difference as long as the temps are in that range from 32- 40 F. I think they would be just fine if they are lower than that as long it the seed can handle being at that temp (i.e. not actually at a germinating stage). The seed being exposed to the air and drying out while being at freezing temps prob would be good either.
