AIS, its sections, and the cooperating societies (like ASI) make the rules.
When a new variety is registered, the hybridizer includes the category code on
the application blank. So the hybridizer makes the decision, but is responsible
for following the rules.

Yes. The name has to be approved by AIS and there are a lot of rules to follow.
Picking a legal name is the easy part. The real challenge is in coming up with
a name that's not only desirable and legal, but hasn't already been used.
