the Neighbor's hedge


Yes, in theory we have the right to plant what we want on our own property. One should however consider the neighbors.

I took out three Pampas Grass thirty years ago because I was told some of neighbors were allergic to the pollen but mainly because they started seeding everywhere, even the neighbors. It was not a "neighborly" plant.

My present neighbor has an aggressive hedge. And this brings up two questions. The first is legal and therefore is addressed to Californians in particular. The other is a social one and replies are invited from everyone.

Question #1: The Legal one. How far can I cut it? Do I have to stop at the property line (the next day it will be over the line)? Or do I have a right to cut it back a foot inside the neighbor's property line, provided it does not alter the view from his/her side?

Questions #2: The Social One. What is the customary,neighborly, social amount I can cut, again providing it does not affect the view from his/her side?

Unfortunately, this neighbor has not shown any inclination to be neighborly with me. So there is a certain amount of apparent low grade animosity present!

I am at present in the process of trying to reclaim some of the sun that this hedge is hiding. I would really appreciate a bundle of opinions on this.
