One thing to note is that the MSNBC article at

mentions that this individual had to settle for other reasons.  It seems
that he was also a professor of computer science and was trying to hack 
into the other company's server after the lawsuit was filed.  

I'm still trying to figure out what to say to the lists (mostly because
I'm researching the story), but I'll post a note today.
