We owned a house in Delmar, New York which had a provision in the deed that prohibited us from brewing spirits on the land or selling spirits or assisting in any way trade in spirits. The serving of spirits was prohibited. It had been a farm built down the road from a still existing and thriving Methodist church. Several other covenants were on that deed including one that prohibited the owner of the land giving water to any persons in the area engaged in the making of spirits. The covenant was over 175 years old and I often wondered if anyone cared at this point. A list of thing that could be traded or sold was on deed, spirits were definately out.
When we were looking for land in the 90's, we saw plenty of covenants. Some of the covenants were sensible (governed the number of unregistered vehicles, 3 max), prohibitive (huge minimum square footage, 3100), cosmetic ( only certain colonial style) and just plain weird (no poultry unless you had a heated coop). I did see a few governing landscaping, including one that disallowed flower or vegetable gardens in view of the street and another that disallowed the collection of maple sap...... The mind boggles.... this in New Hampshire, the land of Live Free or Die and maple syrup.
We lucked out and got land with none!
