A magazine just sent me a contract that I have never seen before--shared
rights. Briefly, the contract asks for all rights to the article for 90
days after publication and the right to use the article on the web or in an
anthology in the future. I can use second, third or 90th rights materials
to construct the article and can reprint, broadcast or use on the web the
article after 90 days.
What do you think of this? Is it a good outlet to recycle materials for
added income, or is the contract a clever way to avoid paying royalties on
books or electronic rights fees?

Doreen, the part of this agreement that would make me nervous is
the fact that they have all rights for 90 days. What will
they do with it in those 90 days?
The second question I have is whether you want to give them the
right to use the article on the web or in an anthology in the future
-- if you want to resell the article to a website, will they balk at
paying for something that is already posted elsewhere?
Finally, what kind of anthologies do they publish? Is this
something they already do and if so, how are those anthologies used
and/or sold? Would you want to make some additional money for
having your materials sold as part of an anthology?
If they are considering putting out anthologies, what do they
have in mind? I think you need to ask some questions here to
find out if you are comfortble with the situation.
I have agreed to contracts that allow my pieces to be published
in print and then posted on the web for 90 days after which all rights
revert to me. That was comfortable to me and worked for the
client.
