Re: Article rights


Probably the lawyers in our group can be more specific, but here is my 
understanding of the situation.

If you had a contract for the piece when you wrote it a few years ago, you 
must examine it to see what rights you sold to that publication.

If you had no contract with the original publisher, without question you 
still own all the rights. They are yours unless you enter into some kind of 
contract in which you let go of them.

Most magazines used to buy one-time rights, with or without a contract, but 
now they want to secure additional rights so they can put the articles on 
their websites.

Organic Gardening Magazine used to buy all rights -- not sure what they do 
lately.

As for the gratis publication online, I think you are probably best off 
without a contract, but a one-time use contract is OK too. Once your article 
is online it may discourage a future sale of the piece, but on the other 
hand it may lead to someone finding you and giving you an assignment.
