Re: Contract Question


My impressions:

About the rights, do you have your original signed contract, or did it go the way of the agent? Did you grant all rights to the original publisher? If you did not grant the publisher all rights or specifically grant someone the digital rights, those rights are still yours.

What about the illustrations, if any? Do you have the rights to the illustrations? Will new ones be needed? If so, who is responsible?

10% of net seems ungenerous to say the least and could result in an amazingly low amount for you. Is there an advance? By the way, my experience has been that my books sell far better on paper than they do as ebooks, although this is slowly starting to change.

Also, if the publisher is planning to pay software developers to create whatever actions will be happening in the "Electronic Multimedia Version" this could eat up all the money and leave no net profit.

I agree with Kirk. The GWA lawyer might help a lot.

First question.  Who owns the rights?  Have they reverted to you?

Point - 25% is the industry standard but as somebody pointed out - gross
versus net is critical and quite frankly, even at 25% you won't make a lot.

On the other hand, if you own the rights and / or can have them reverted
and if the topic is marketable - then it may be a candidate for doing it
yourself.
