Re: peonies sprayed

A few searches on google reveals a few facts, among them that Extreme is a combo of Roundup (active ingredient = gyphosate; used in this product for "rapid knockdown") and Pursuit (active ingredient = an ammonium salt of imazethapyr;?used here as a residual against grasses and broadleaves.)?

>From that info about Pursuit, I assume it's a pre-emergent.?But how long-lasting I don't know.??(It's an agricultural product I know nothing about.)

Copy of 27-page Pursuit label is at http://www.cdms.net/LDat/ld01S004.pdf.? Lots of legal advice there about drift control and responsibility.

Your friend needs to talk with agricultural specialists very?familiar with these herbicides and with status qualifying them as expert witnesses.? So, she's on the right track -- "She's been in touch with state and federal authorities re: not following label instructions by spraying on a windy day, Purdue and area extension folks."

As you may know, the recovery of her peonies depends upon the dose received, also the?persistence of the pre-emergent.? Time will tell.

She wants to know if a peony recovered and survived to bloom again in
a year or two or were the plants goners? She was really upset and I
don't blame her. The farmer's reason was that he had a thousand acres
to do and the field adjacent to her farm was on the schedule for that
day.

I drew a crowd of 185 people at Plymouth Nursery in Plymouth,
Michigan last Sunday. The topic - Hydrangeas .
Folks here want to know how to get them to bloom.

C.L.,

What a fabulous piece of feedback. I'll bet you didn't need that sushi at all
after that -- you were running high enough already!

As for Rose Marie's question, most of my talks this season have been on
(Successful) (Healthy) Vegetable Gardens. When it's not been veggies, the talks
have been the usual: Foolproof Hydrangeas, Low Toxic Solutions, and of course,
plugging my new book.

Hooray for spring!

Dear GWLers -- I just got a call from a friend in the area who has a
huge cut flower buisness, including contract work for wholesalers.
She lives in a rural setting and last Friday, her farmer/neighbor
sprayed two herbicides, including Extreme. The winds that day were
30mph or better and more than 12 rows of her prized peonies have
taken a hit from the drift of the chemicals.

She's been in touch with state and federal au
thorities re: not
following label instructions by spraying on a windy day, Purdue and
area extension folks. She's also spoken with a couple of other peony
growers, including Klehm's, but no one has had their crops (or
plants) sprayed w/this stuff.

I told her I'd ask to see if anyone one of us have had this
experience or perhaps some of our readers/listeners, etc., have had
this happen.

She wants to know if a peony recovered and survived to bloom again in
a year or two or were the plants goners? She was really upset and I
don't blame her. The farmer's reason was that he had a thousand acres
to do and the field adjacent to her farm was on the schedule for that
day.

Any other resources you suggest she contact, please let me know that,
too. Off-list is fine.

Thanks.

I don't know about the effect on peonies, but I do know that about 15 years
ago, Eero Ruutilla (Nesenkeag Farm, Litchfield, NH) suffered damage from a
neighbor's spraying. His family and his crops were affected. He knows a fair
bit about litagation in these cases and is generous with help and
information. Mind you, it's his busy season, so he probably can't give
anyone much time right now. BUT, he is a really good resource.

In the meantime, she should photodocument the damage at the very least. If
it were me, I'd freeze some damaged leaves--goodness knows if the material
survives freezing, but if it doesn't, she'll at least have proof of
exposure.

Good luck to her.

Hi, Jo Ellen!

That's an awful tale!

Fortunately, I can't speak from experience, but she might get on the Cricket
Hill website (www.crickethill.com/<http://www.crickethill.com/>)
to get their contact info and consult with them. They are a very small Ct.
family-owned Tree Peony business but they also do herbaceous peonies and have
vast amounts of horticultura
l knowledge and experience, not to mention possibly
other contacts in the peony business.

Jo Ellen,

I agree with Miranda -- document the damage with plenty of photographs --
of large groups of plants, of individual plants, and close-ups of damaged
leaves, buds, etc., plus freeze and dry (both) specimens from some of the
damaged plants.

This kind of thing should never happen, and people, institutions, or
companies who use chemicals irresponsibly must be held accountable for the
damage they do to their neighbors and their property when they do so.

In any case, her crop of peonies this year is probably damaged beyond
repair, so she will take a monetary loss this year. Even if t
he plants survive,

their production may be damaged for one or more years in the future; again,
she will lose financially. And if the plants die, she will lose even more,
from having to dig and replace the plants and the lost years of production
while they grow to mass-production size again. In all cases, the loss
could be significant, and in the last scenario, it most definitely will be
substantial. For this reason, I highly recommend that she contact an attorney
immediately for further guidance, along with pursuing horticulture
solutions. Based on the cavalier response she received from the farmer, it is
obvious he will be non-cooperating and possibly even hostile. She must begin
now
to prepare herself for litigation by documenting everything, including
telephone conversations, remedies tried, etc.
