First--you'd hire a lawyer to sue in your state (argue that the contract was
made there since that's where you are) or IN the state in which the
publisher is located.

Second, and more importantly, both of your amounts would fall under the
small claims rules (here in WI anyway). No lawyer needed--you can usually
get any help you need from the clerk of courts office. Simply buy the forms
from the clerk, fill them out, file, serve and appear.
