First off, can he return them?  or can you seal them?  I would opt for 
sealing them with urethane or something similar.  The do leach arsenic and I 
don't think that anyone needs more of that.  If you elect to return them I 
would still seal whatever wood you get to delay the natural occurring rot.  
I, myself, am using cinder block since it lasts a very long time and I have 
acid soil and the alkali they leach will be balancing.
