It's too bad if this forces you into any sort of legal hassle, but at
least you have an expert who has said that the privets will regrow in
8-9 months, so your "neighbor" will be hard put to prove that any
long lasting damage has occurred. I hope you can resolve this
problem.
When I first purchased my home, there was a small maple that between
the city sidewalk and my house - only about 10 feet from the house,
and unfortunately the city property came up that far so that the tree
actually belonged to the city. I went down and talked to the city
forester, and explained that I was doing some landscaping (a
retaining wall for a sloping lawn) and that because of that and the
fact that I felt the tree was really too close to the house, I asked
to have permission to remove it. He was very understanding and
agreed that the placement of the tree was not the best and so gave me
permission. Just to back myself up, I had him sign a statement that
he had agreed to this removal. At a subsequent meeting with the city
for permission to build the retaining wall, the subject came up that
the tree had already been removed. The Chief City Engineer (who
happened to be a real jerk) and who oversees the Forestry Department
almost had apoplexy when he found the tree was gone. Fortunately, I
had signed permission and there was nothing he could do. I lucked
out on this one.
